The DJC provides news and public records for Pacific Northwest business professionals in the industries of construction, architecture, engineering, commercial real estate and law.
Most debates about lawyers professional responsibilities ultimately devolve into discussions of the “role” of lawyers-including the functions lawyers serve in the legal system, how lawyers should achieve those functions, and how lawyers should reconcile conflicts between competing interests that are potentially affected by their conduct. The notion of a lawyers role can be helpful for identifying principles of behavior. Thus, for example, whether attorney-client confidentiality is appropriate and whether exceptions should be acknowledged depends on the conception of lawyers from which one starts. If lawyers are to be clients sole and fully-allied champions, then strict confidentiality rules make sense. If lawyers are to be objective intermediaries between clients and society and have independent obligations to the law, exceptions seem more acceptable. The task of code drafters is facilitated when they can proceed from the assumption that a single paradigm governs the lawyers role-either a paradigm encapsulating a theory of behavior (how lawyers ordinarily act) or a paradigm encapsulating a normative ideal (how lawyers should act). When code drafters rely upon multiple paradigms (for example, lawyers should act as clients alter egos and as officers of the court), inconsistent regulatory mandates can result, and lawyers may become confused about their functions. The ABAs 1908 Canons of Ethics, which prevailed in most American jurisdictions throughout the early twentieth century, suffered from an emphasis on inconsistent ideals.1 The bar was in a state of disagreement about lawyers roles and lawyers had no point of reference for determining how to act.2 Therefore, when the ABA adopted the first concrete professional code in 1969,3 it became important for the drafters to identify an over-arching theory. By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted. Part I of this Article identifies some of the different images of lawyers that exist6 and the ramifications of emphasizing each image in the professional codes. Initially at least, this Article takes no position on the accuracy of the images in describing lawyer behavior-for example, whether lawyers act in a selfinterested manner or whether lawyers feel bound by unenforceable professional norms. As a practical matter, each of the images has solid footing in some respects. That is to say, each is based on a valid characterization of how lawyers act in some situations. Part I will suggest, however, that relying upon multiple paradigms inevitably fosters schizophrenia on the part of the code drafters.

Capital Market DivisionThis is the main division of an Investment bank and is engaged in the traditional activities of an investment bank. This division performs a number of activities, some of the major functions performed by this division are: Corporate finance; Securities underwriting; Merchant banking; Leveraged buy outs (LBOs); Private placements; Money market instruments; Privatization.* Corporate Finance: It is normally the major function performed by the bank. There are three objectives of corporate finance, i.e. to obtain the lowest cost of capital, to obtain capital that most properly matches sources to uses, and to obtain optimum value for investments. The activities includes scrutinization, facilitating mergers and acquisitions, merchant banking, money markets, etc.* Securities Underwriting: While offering the shares of a company to general public, the company signs an underwriting agreement with the bank, that in case the offer is not fully subscribed, then the bank will buy the remaining shares from the company. Another form of underwriting is that, the investment bank buys the securities from the issuer at a specific price and sell these securities to the investors at a price which the bank feels is appropriate. In this type of underwriting all the risk is borne by the investment bank because if the bank has asked for higher price, the offer may get under-subscribed, and the bank will be stuck up with the un-subscribed shares, thus blocking its capital. On the other hand if the offer gets fully subscribed or over-subscribed, then the bank will enjoy the whole profit. The types of securities that are underwritten by the bank are preferred stock, common stock, convertible debentures, corporate bonds, and some instruments of money markets are also included.* Merchant Banking: This function of capital market division provide financial services to the businesses, like facilitating merges and takeovers, and advising and arranging share and loan issues for the institutions or clients.
This week: Looking after your money online. The editors of Motley Fool have posted a useful primer on whether online banking — also known as PC banking, Internet banking, home banking or electronic banking — is something that makes sense for you. One of the first guidelines on the Motley checklist is whether you already use a personal-finance program like Quicken or Microsoft Money. Increasing need for financing from money and capital markets During the last six months, banks funding needs in money and capital markets have increased by about NOK 20 billion. The effect of this development on liquidity risk is uncertain because banks increased funding needs have been financed primarily by long-term loans. Bond debt has increased by a good NOK 26 billion the last half year, whereas short-term debt in the form of short-term papers and deposits and loans from other financial institutions has decreased by just NOK 3 billion. At the same time, there has been a marked shift in banks short-term debt from foreign to domestic sources. Short-term funding from abroad has declined by about NOK 13 billion (see Chart 5.1). Relatively high liquidity risk in small and medium-sized banks During the last half year, the three largest banks have reduced their short-term debt somewhat and their liquid assets have increased slightly as a percentage of total assets (see Chart 5.2). The share of gross lending financed by foreign sources has risen and there has been a shift towards an increased share of bond debt (see Chart 5.3).

EVERYONE ON THE CREW pulls together when they row. Its much the same for the engineers who design the boats. As a manufacturer of racing-standard rowing boats, Filippi Boats of Donoratico, Italy, is using computational fluid dynamics to design what engineers hope will be winning boats next month at the Summer Olympics in Athens, Greece. Using CFD to simulate a rowing boat is more complex than using the application to optimize a boats hull design, which is a common use for the technology, according to Filippi Lido, who owns Filippi Boats. While most boats are propelled through the water at a constant rate, a rowing boat moves forward with the crews rhythmic rowing action. As the boat accelerates and decelerates through each stroke, both the position of the boat and its attitude in the water are dynamically modified, which makes for a complex problem with multiple degrees of freedom. For the past year, engineers at Filippi Boats have been using Comet CFD software from CD adapco of New York. The boatmaker is also working with engineers at the Universita Politecnico di Milano to design the boats. The engineers simulate the periodicaccelerations caused by each stroke of the oars. The accelerations cause time-dependent changes of resistance and propulsion.

LOS ANGELES, May 28 /PRNewswire/ — Personal Injury Lawyer in Los Angeles is offering complimentary consultations to clients who have been the victim of personal injuries. Lets face it - even before the economy took a turn for the worse, hiring a lawyer was expensive. The worst part is that many lawyers charge just for a simple consultation, after which they might tell you they cannot even represent your case. However, many personal injury cases have very valid claims that can bring the injured person a significant amount of money - money they will never see if they do not take the risk of hiring a personal injury attorney. To encourage individuals to seek legal advice without worrying about throwing money away, the law offices of Brad Lee are offering personal injury case consultations for free. Located in Los Angeles, one of the top cities in the nation for dog bites and car accidents, the law offices of Brad Lee are staffed with expert personal injury lawyers who have successfully represented thousands of clients. By offering a free client consultation, Mr. Brad Lee wants to give people a chance to find out if their claim is valid and if it has the potential to reach a settlement or favorable judgment - all without paying a dime. For victims of personal injury due to someone elses negligence, the opportunity to get this information for free from a qualified personal injury lawyer is just what they need. HEAD, Glenn, ed. Hotwire Comics; volume 2. Fantagraphics Books. 136p. illus, c2008. 978-1-5609-7891-6. $22.99. A This anthology features over 20 contemporary artists; contributors include Johnny Ryan, Mary Fleener, Glenn Head, Christian Northeast, Onsmith and Tim Lane. Some of the stories in this entertaining oversized (9″ x 12″) paperback are silly; some are offensive; some are just plain weird. None is for kids. We have William Reich, discoverer of orgone energy; a woman tripping on “Electric Ladyland”; a robot chicken; a coma dream about The Clash; sex, sex and sex; a flock of books falling from the sky; and the riveting tale of the Plainville Downtown Business Associations bake sale (my favorite). The contributors to Hotwire Comics, Vol. 2 all have their own styles, but I glimpsed shades of luminaries such as Robert Crumb, Charles Burns, Roger Langridge and Daniel Clowes in the full-color art. The storytelling runs the gamut from the fantastic to quasi-memoir, magic realism and gibberish. Contains vulgarity, nudity, violence, depictions of drug use and full pages of eye-popping psychedelic art; recommended for adult graphic novel collections featuring alternative, underground and contemporary comics. Do not shelve this anywhere near the Young Adult section. George Galuschak, YA Libn., Montvale PL, Montvale, NJ

Where to find a cosmetic surgeon Can you tell me how to find a reputable cosmetic surgeon who specialises in facial surgery? Is Harley Street in London a good starting point? Harley Street used to be full of some of the worlds best doctors, but recently it has attracted more than its fair share of scoundrels - anyone can rent a room in Harley Street and the address is no guarantee of good medical care. Go via the British Association of Aesthetic Cosmetic Surgeons at the Royal College of Surgeons, 35-43 Lincolns Inn Fields, London WC2A 3PN. Send them an A5 SAE and ask for a list of approved members and their information pack. All their members are qualified surgeons and, as a rule, I would only use their members or doctors of a similar stature (those with an NHS consultant post in cosmetic surgery). Dont pay anything up front - most doctors only send their bills in after they have done the operation. Can you suggest a remedy for recurrent mouth ulcers? I am 43 and have suffered from ulcers on and off for 20 years - they tend to come out in crops and the pain is so bad that I cant eat.

WHY NAME CHANGE UPSET CHIROPRACTORS The Florida legislature voted to change the name of chiropractic to “chiropractic medicine” in the closing hours of its legislative session (SB2128). The initiative for the change was fostered by the Florida Chiropractic Association to standardize the term “chiropractic physician” in every Florida statute, and to change the name of the licensing agency from the Board of Chiropractic to the Board of Chiropractic Medicine. All of this was done without an advance notice, a public hearing, or a debate. The International Chiropractors Association is extremely upset with this turn of events. The debate that is sure to ensue resurrects the issues that have divided chiropractic for nearly a century. As strange as it may seem, those who object to chiropractors being labeled “physicians,” and their expansion into medical practice, often find allies among the Straights. To understand the reason why, one must be familiar with the basis for the long-standing rift between “straight” and “mixer” chiropractors. In 1895 Iowa magnetic healer Daniel Palmer proclaimed that he had discovered the single cause for all disease. This was alleged to be partially displaced vertebrae (ie, “subluxations”) that impinged upon the free flow of the metaphysical life force he dubbed the “Innate Intelligence.” In the textbook, The Neurodynamics of the Vertebral Subluxation (Chiropractic Publishers, 1973), Homewood describes Palmers biotheology: The founder of.chiropractic appreciated the working of Universal Intelligence (God); the function of Innate Intelligence (Soul, Spirit or Spark of Life) within each, which he recognized as a minute segment of Universal; and the fundamental causes of interference to the planned expression of that Innate Intelligence in the form of mental, chemical and/or mechanical stresses, which create the structural distortions that interfere with nerve supply. Palmer asserted that subluxations could be detected and corrected by hand. The name “chiropractic” literally means “done by hand” (chiros=hand+practos=practice). Thus, the essence of chiropractic is that it is a drugless, non-surgical practice.

ATLANTA — Peach State Credit Solutions is pleased to announce the “Fresh Start”
program designed to award free credit repair to one individual per month.

It is no secret that some have become over-extended while others are
still paying for credit mistakes made long ago. These factors, as well
as others, lead to a lower credit score. Often times an individual’s
credit score is not an accurate picture of their current situation. The
simple service that Peach State Credit provides can give most people
with bad credit a second chance.

All Peach State Credit Solutions customers will be automatically
considered to win. The winning candidate will receive a full refund on
the credit restoration service, a value of $695.00. Winners will be
chosen on the last Friday of every month starting March 27, 2009.

“It is our ethical responsibility to do what we can do have a positive
impact on the community. By helping to restore the credit rating of one
individual per month for free, we can be part of the solution. Fresh
Start can improve the standard of living for a very deserving
individual,” says William Mikula, Manager of Peach State.

INTRODUCTION AND SUMMARY In order to take advantage of credit portfolio management opportunities, however, management must first answer several technical questions: What is the risk of a given portfolio? How do different macroeconomic scenarios, at both the regional and the industry sector level, affect the portfolios risk profile? What is the effect of changing the portfolio mix? How might risk-based pricing at the individual contract and the portfolio level be influenced by the level of expected losses and credit risk capital? This paper describes a new and intuitive method for answering these technical questions by tabulating the exact loss distribution arising from correlated credit events for any arbitrary portfolio of counterparty exposures, down to the individual contract level, with the losses measured on a marked-to-market basis that explicitly recognises the potential impact of defaults and credit migrations.1 The importance of tabulating the exact loss distribution is highlighted by the fact that counterparty defaults and rating migrations cannot be predicted with perfect foresight and are not perfectly correlated, implying that management faces a distribution of potential losses rather than a single potential loss. In order to define credit risk more precisely in the context of loss distributions, the financial industry is converging on risk measures that summarise management-relevant aspects of the entire loss distribution. Two distributional statistics are becoming increasingly relevant for measuring credit risk: expected losses and a critical value of the loss distribution, often defined as the portfolios credit risk capital (CRC). Each of these serves a distinct and useful role in supporting management decision making and control (Exhibit 1). Expected losses, illustrated as the mean of the distribution, often serve as the basis for managements reserve policies: the higher the expected losses, the higher the reserves required. As such, expected losses are also an important component in determining whether the pricing of the credit-risky position is adequate: normally, each transaction should be priced with sufficient margin to cover its contribution to the portfolios expected credit losses, as well as other operating expenses. Credit risk capital, defined as the maximum loss within a known confidence interval (for example, 99 percent) over an orderly liquidation period, is often interpreted as the additional economic capital that must be held against a given portfolio, above and beyond the level of credit reserves, in order to cover its unexpected credit losses. Since it would be uneconomic to hold capital against all potential losses (this would imply that equity is held against 100 percent of all credit exposures), some level of capital must be chosen to support the portfolio of transactions in most, but not all, cases. As with expected losses, CRC also plays an important role in determining whether the credit risk of a particular transaction is appropriately priced: typically, each transaction should be priced with sufficient margin to cover not only its expected losses, but also the cost of its marginal risk capital contribution. In order to tabulate these loss distributions, most industry professionals split the challenge of credit risk measurement into two questions: First, what is the joint probability of a credit event occurring? And second, what would be the loss should such an event occur?
